Terms of Use
1. Acceptance of Terms
By accessing or using Pinealizer (the "Service") at pinealizer.com, including the Free plan or any paid subscription plan, you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Service.
These Terms apply to all users: users on the Free plan, subscribers on the Monthly plan, purchasers of the Lifetime plan, and any team members invited to a workspace. Your acceptance of these Terms and the Privacy Policy is required at account creation and is recorded with a timestamp and Terms version.
2. What the Service Does
Pinealizer is a website visibility platform. It scans websites to identify technical SEO issues, AI readability gaps, and generative engine optimization (GEO) weaknesses, and returns a prioritized list of recommendations. The "Service" includes the pinealizer.com website, the API, and the Pinealizer desktop application (Windows, macOS, Linux), which performs page rendering locally on your machine and stores your audit data locally.
The Service performs automated crawls, including JavaScript rendering and AI bot simulation (GPTBot, ClaudeBot, PerplexityBot). By submitting a URL to the Service, you confirm that you have the right to authorize crawls of that website.
- You may only scan websites you own or have explicit written permission to audit.
- You may not use the Service to crawl websites with the intent to harm, disrupt, or exploit them.
- You may not use crawl data to build competing crawl indexes or resell raw data without a separate written agreement.
3. Accounts and Access
You must create an account to use any paid feature. You are responsible for keeping your login credentials secure. You are responsible for all activity that occurs under your account.
You may invite team members to your workspace. Team members have access to the projects and audits within that workspace. You are responsible for the actions of all team members you add.
We reserve the right to suspend or terminate accounts that violate these Terms, abuse the crawl infrastructure, or engage in activity that harms other users or the Service.
4. Age Requirement
You must be at least 18 years old to create an account or use any paid feature of the Service. By creating an account, you confirm that you meet this requirement.
If you are under 18, you may not use the Service. We do not knowingly collect data from anyone under 18. If we discover a user is under 18, we will immediately terminate their account and delete their data.
5. Subscriptions and Billing
The Service is offered on a subscription basis. There are no credits, no per-page metering, and no top-up packs. Rendering runs on your own machine via the local app worker; the server provides the analysis and your account.
Paid plans — Monthly ($9.99/mo) and Lifetime ($199.99 one-time) — have no usage caps: unlimited audits, unlimited projects, unlimited pages. The Free plan requires account signup and is limited to 1 project and up to 500 pages; one Free account per person and per device.
Subscriptions are billed in advance by Lemon Squeezy, our payment provider. You may cancel at any time from your billing settings; cancellation takes effect at the end of the current billing period, and you retain access until then. The Lifetime plan is a single payment with no recurring fee.
ALL SALES ARE FINAL. We do not offer refunds — including for partial billing periods, unused time, dissatisfaction with results, or discontinuation of the Service (see Section 13) — except where a refund is required by mandatory applicable law. EU/UK consumers have a limited statutory right to cancel within 14 days of purchase (see Section 6).
- Free: $0 · 1 project · up to 500 pages · signup required · renders on your machine.
- Monthly ($9.99/mo): unlimited audits, unlimited projects, renders on your machine.
- Lifetime ($199.99 once): everything in Monthly for the lifetime of the Service — no recurring fee (see Section 13 for what "lifetime" means).
6. EU and UK Consumers: Right of Withdrawal
If you are a consumer based in the European Union or United Kingdom, you have the right to withdraw from a contract for digital services within 14 days of purchase, without giving any reason (the "cooling-off period").
However, by starting a paid scan or using any paid feature immediately after purchase, you expressly request that the Service begin before the cooling-off period expires. By doing so, you acknowledge that you lose the right of withdrawal once the Service has been fully performed, or once you have begun using the Service.
If you have not yet used any paid feature and wish to exercise your withdrawal right within 14 days, contact us at contact@pineido.com. We will process a full refund within 14 days.
For disputes that cannot be resolved directly, EU consumers may use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. UK consumers may contact the Citizens Advice consumer helpline.
7. White-Label and Agency Use
Paid plans include white-label PDF reports. You may deliver these reports to your clients under your own brand. You may not claim that the underlying technology is proprietary to your agency without disclosing that it is powered by Pinealizer.
You may not resell raw API access or audit infrastructure as a standalone product without a separate reseller agreement.
8. Your Data and Privacy
We collect ONLY account data: your email, name, encrypted API keys you choose to add, billing status, and minimal operational records (audit timestamps, abuse-prevention signals). We do not collect or retain the content of the webpages you audit: page rendering and audit data storage happen locally on your machine via the desktop application, and any page content processed server-side is handled transiently in memory to produce your report and is not retained. Full details are in our Privacy Policy at /privacy.
We do not sell your personal data to third parties. We use it to operate the Service, send product and billing communications, and (with your consent) marketing updates.
Audit reports you generate are yours and live on your machine. If you cancel your account, we retain your ACCOUNT data for 90 days to allow reactivation, after which it is permanently and irreversibly deleted.
We use Supabase for data storage. Payments are processed by Lemon Squeezy; your payment details are handled by Lemon Squeezy and are never stored on our servers. Emails are sent via Resend.
GDPR and UK GDPR: Pinealizer acts as data controller for account and usage data, and as data processor for crawl data you submit. Business customers (B2B) may request a Data Processing Agreement (DPA) at contact@pineido.com.
9. AI-Generated Outputs
The Service uses automated analysis, NLP models, and AI bot simulation to generate scores, recommendations, and fix suggestions. These outputs are informational and not a guarantee of any specific ranking or citation outcome.
SEO and AI search are dynamic fields. Scores and recommendations reflect the state of the scanned page at the time of the scan and may not account for search engine algorithm changes after that date.
You are responsible for reviewing recommendations before implementing them. Pinealizer is not liable for ranking changes, revenue impact, or site issues arising from implementing or ignoring recommendations.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PINEALIZER EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that the results obtained from using the Service will be accurate or reliable.
Some jurisdictions do not allow the exclusion of implied warranties. If you are in such a jurisdiction, these exclusions apply only to the extent permitted by law. EU/UK consumers retain statutory rights that cannot be excluded.
11. Prohibited Uses
You may not use the Service to:
- Scan websites you do not own or have explicit permission to audit.
- Scrape, copy, or redistribute the Service's analysis algorithms, scoring models, or infrastructure.
- Reverse-engineer, decompile, or attempt to extract source code from the Service.
- Upload malicious content, attempt injection attacks, or disrupt Service infrastructure.
- Use automation to exceed your plan's crawl limits or circumvent plan controls.
- Impersonate another user or create accounts to evade a ban.
- Use the Service for any purpose that violates applicable law.
12. Intellectual Property
Pinealizer owns all rights to the platform, scoring models, analysis algorithms, report templates, and product interface. These Terms do not transfer any ownership to you.
You retain full ownership of your website content and the data you provide. By using the Service, you grant us a limited license to process your URLs and content solely to provide the audit and analysis features.
13. Service Availability
We aim for high availability but do not guarantee uninterrupted access to the Service. Scheduled maintenance, infrastructure issues, or events outside our control may cause downtime. We are not liable for losses arising from Service unavailability.
WE RESERVE THE RIGHT TO MODIFY, SUSPEND, OR PERMANENTLY DISCONTINUE THE SERVICE (OR ANY FEATURE OR PLAN) AT ANY TIME, FOR ANY REASON, WITHOUT NOTICE AND WITHOUT REFUND, except where a refund is required by mandatory applicable law. "Lifetime" in the Lifetime plan means the operating lifetime of the Service, not the lifetime of the purchaser; if the Service is discontinued, Lifetime access ends with it and no refund is owed.
The Service is provided "as is" (see Section 10). You accept that features may change, be replaced, or be removed as the product evolves.
14. Limitation of Liability
To the maximum extent permitted by law, Pinealizer's total liability for any claim arising from the Service is limited to the amount you paid us in the 3 months preceding the claim.
We are not liable for indirect, incidental, special, or consequential damages, including lost revenue, lost rankings, or business interruption, even if we were advised of the possibility of such damages.
Some jurisdictions do not allow limitation of certain warranties. If you are in such a jurisdiction, these limitations may not fully apply to you.
15. Termination
You may cancel your account at any time from your billing settings. Access continues until the end of the current billing period.
We may suspend or terminate your account immediately if you violate these Terms, abuse the crawl infrastructure, engage in fraudulent activity, or create legal or regulatory risk for the Service.
On termination, your access to the Service ends. Your data is retained for 90 days and then permanently deleted, unless a longer retention period is required by law.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the effective date at the top of this page and, for material changes, send a notification to your account email.
Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
17. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Pinealizer is registered, without regard to conflicts of law principles.
For EU and UK consumers: nothing in these Terms limits any rights you have under mandatory consumer protection laws in your country of residence. Those rights apply regardless of this governing law clause.
Before initiating any legal proceeding, contact us at contact@pineido.com and allow 30 days for informal resolution. Most issues are resolved within 3 business days.
EU consumers may also use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr
